Why hasn’t the ICJ ruled that Israel is committing genocide?
The Independent International Commission of Inquiry was established by the UN Human Rights Council to investigate alleged violations of international humanitarian and human rights law in the Occupied Palestinian and on September 16, 2025 concluded thatIsrael’s actions in Gaza amount to genocide under the 1948 Genocide Convention. In its September 16, 2025 report, the Commission concluded, in substance, that:
- Israeli conduct in Gaza includes:
- Destruction of life-sustaining infrastructure
- Mass killing of civilians
- Forced displacement
- Deliberate starvation and denial of essentials
You can add to that that Gazans have ‘no means of escape‘.
Chris Sidoti, a former human rights commissioner and one of Australia’s most experienced international legal experts, told the National Press Club the Palestinians in Gaza ‘have no means of escape’.
‘The Israeli authorities since the first day have been pursuing an operation of total destruction,’ Sidoti said. ‘And the fact that you’ve got 2 million people squeezed into an area half the size of Canberra who cannot get away from saturation bombing, starvation, denials of medicines and medical equipment, access to hospitals, access to schools for their kids makes this unique’
