find attached and below the press statement that was meant to go out last night after speaking with a redfern police officer relative to the actions being taken against the family of tj hickey and myself as the president of the indigenous social justice association. i was to either agree to the terms, or dictates, of the redfern police command to begin the rally at tj hickey park at waterloo and to finish at the block at redfern, or failing that, to have no 11th anniversary rally and march to honour tj’s life and the circumstances of his most tragic and callous death arising from a redfern police pursuit.
the release is self-explanatory and remains to date as our stated action. there is, however, an error of information within it and that is the changed time relative to our appearance before justice garling to reply to the attached documentation presented to us by the crown solicitors office. we are to appear at 3.30pm at court 11c for a mention tomorrow, wednesday 11 february, and to appear again on friday at 10am, again in court 11c to show due cause why the summons is in error as to its stated facts and in its intent to stop the 11th anniversary march and rally for tj hickey arising from a redfern police pursuit on 14 february, 2004.
the court will be open, i believe, to the public on the friday 13 february and should you wish to come and support our arguments then please attend court 11c at the supreme court, queens square and macquarie street, sydney.

REDFERN POLICE DENY 11TH ANNIVERSARY MARCH
FOR FAMILY OF TJ HICKEY
REDFERN POLICE CONTACTED THE PRESIDENT OF THE ISJA, RAY JACKSON, AT 5.45PM MONDAY EVENING INFORMING HIM THAT THEY HAD REJECTED THE ADVISED MARCH ON THE 14TH FEBRUARY FOR “SAFETY REASONS” AND UNLESS WE AGREED TO FINISH AT THE BLOCK AT REDFERN THEY WOULD TAKE US TO COURT TO HAVE THE MARCH LEGALLY BANNED. WE HAD JUST 18 HOURS TO COMPLY.
THE REDFERN POLICE WERE AWARE THAT RAY JACKSON WAS TO BE IN CANBERRA UNTIL FRIDAY THE 13TH FEBRUARY.
THE LETTER GIVEN TO ISJA ON FRIDAY 6TH OF FEBRUARY WAS NOTHING OTHER THAN A PLANNED PRELUDE TO THE THREATENED COURT ACTION.
ISJA IS BEING LABELLED AS A VIOLENT OUT-OF-CONTROL GROUP THAT CONTINUALLY ATTACKS THE REDFERN POLICE ON OUR MARCHES. NOTHING IS FURTHER FROM THE TRUTH AND ANY MINOR ISSUES THAT HAVE OCCURRED HAVE BEEN AMICABLY RESOLVED BETWEEN THEM AND US.
ISJA WILL APPEAR IN THE MAGISTRATES COURT, MACQUARIE STREET SYDNEY ON THURSDAY 12THFEBRUARY. WHERE WE WILL ARGUE AND DEFEND OUR ABSOLUTE RIGHT TO MARCH IN COMPLETE SAFETY AS WE HAVE DONE OVER THE PREVIOUS 10 YEARS.
THE HICKEY FAMILY HAVE ADVISED US THAT THEY WISH TO BRING THE TRAGIC DEATH OF TJ RESULTING FROM A REDFERN POLICE PURSUIT TO THE FULL VIEW AND KNOWLEDGE OF THE PUBLIC.

find attached the decision from schmidt, j. that states in legalese and/or secret english that our advertised isja march from tj hickey park at the fence-line to invasion day park at circular quay has been prohibited even though the redfern police had no wish to stop the march. no legal reasons for that decision have been handed down as the court finished for the day. we had been in and out of every loophole, rat-hole and proving that the law is indeed an ass.
police experts informed us that one office had no previous experience with the hickey marches of the past 10 marches was suddenly able to explore every nook and cranny of the 11th march and know exactly what will happen when and if isja participated in the long march. but for the supreme order of crystal-ball gazing goes to officer cullen who stated that if isja marched then the outcome would be similar, but maybe even worse, than in ferguson, missouri in the states. unlike the first police expert at least cullen told her honour that he would bet his reputation on that outcome.
these police experts are just so bloody surreal! the pity for us mere mortals is that such powers go unquestioned by the judge.
it is my strong opinion that police are in a world of their own. understood by few but accepted nonetheless. this of course is a fallacy. one has only to be reminded of the young woman shot twice by police in a panic because the young lady was having a mental health problem. i intend to catch up with this death-in-custody sometime next week. another example of that fallacy is that we now have nsw police officers in an absolute orgy of spying, phone-tapping and creating other tools of distrust that are being used not on crime figures of note but upon themselves. that the taxpayers pay for this farce is ludicrous! one item of interest here is that deputy commissioner catherine burn who served at redfern prior to commander freudenstien and passed out with honours. now she looks to be set for a career change.
but i digress. the upshot of the confusion of banning something that the court cannot ban leaves one’s head ringing at the audacity of it all.
our march is banned but the police-favoured march is ok as the will look out for our interests on what is seen as the pc short march. this begins, as normal, at the newly created (by us) tj hickey park at the fence-line at 10.30am. speakers from the community and from interstate will speak in support of obtaining justice for tj and the hickey family. at 11.21 we will remember and honour tj as we do every year.
from there we will march from tj hickey park up philip street, then up pitt street and into redfern street and on to the redfern police station. from there we move to the block. we will still have a need for elders vehicles so those who volunteered earlier, we still need you and your cars. the sound van will be available in which i shall travel.
the rally/march is as normal but we are banned from entering the city centre. this restriction seems only to apply to us as other groups have the freedom of the city. racist? well, the system says no as they tell us they are not practising racism against an aboriginal death-in-custody family and an aboriginal community organisation, oh no! not at all. they are looking after our safety and well-being. fancy that, eh. this is the same evil and twisted logic that locks asylum children into hell camps and psychologically tortures their elders and parents so as to stop deaths at sea. as a country we is one sick puppy! there is just no logic to racism. it is a white power game.
so we still rally at 10.30 and we once again march to the block. we ask for all to join us but in a true action of solidarity and support for gail and her family. we need no other agendas. the police have theirs and we have ours. surely, that is enough.
though a shorter march we still want your support. please come and join us and bring others with you.

we will be appearing before justice schimdt at 10am friday in court 10e.
we ask all our members and supporters in the sydney region to come to court if they possibly can. help us to show them that we are a peaceful organisation.
there is more at stake here than just the right to enact a public protest and procession.
next month is an election and it is just quite possible that the police have been instructed by their political masters to keep civil protests to a minimum. there is also the fact of the complete anathema by the redfern police themselves to be called to account for the death of young tj hickey arising from a redfern police pursuit. to the point where they have lobbied so-called aboriginal leaders like mick mundine and mick gooda in the attempts to force gail hickey to stop calling for justice. it was in 2007 or 2008 when mick mundine told gail to her face words to the effect, “get over it!` move on! your damaging redfern!” land values trump!
after the tj march last year both mick mundine and mick gooda went to the redfern police station and ‘apologised’ to commander freudenstien relative to the isja protests shaming the police. never do that again. i and isja are quite able to make apologies when we think it necessary. and every year we make an apology to the hickey family that yet another year has passed and still no justice for her son’s death has been allowed to happen.
one cannot begin to explain what death-in-custody families suffer. in fact they suffer twice. firstly for their tragic loss but also by the continued indifference to the law of the land that states that the guilty must be held accountable. for over 450+ families this pain, this trauma eats at them everyday of their lives. families are destroyed by this cruelty and white power indifference. the horror, the crimes against the families continue unabated.
bad enough when we must face the system of the white earmuffs and the white blindfolds but when our own do it to us the pain and the shock is excruciating. et tu brute!
i forgot earlier this morning to inform and invite all in the sydney region to not only attend court tomorrow as above but to also attend the isja meeting at the redfern community centre, hugo street opposite the redfern aboriginal tent embassy at the block. we begin at 7pm and finish at 8.30pm.
unlike others, we have nothing to hide and welcome all-commers to our open meetings.
