I don’t have any problem with ignoring laws. When its all said and done there wouldn’t be any point in making laws if someone didn’t break them. Furthermore the vast majority of laws are moronic anyway, as is only to be expected considering the abysmal lack of nous typical of legislators generally. Furthermore there is a presumption that statute law doesn’t bind the crown unless the contrary is expressly stated, further proof of the corruption and inanity endemic to the complete legislative process.
For what its worth, it does appear that common law (ie that resulting from decisions (typically at the higher echelons of the judicial hierarchy) is actually binding on courts lower in the judicial hierarchy, at least until some stupid politician invents a statute to over-ride the particular common law. Even then the presumption applies that Australian laws are not incompatible with international law. I suggest there is a potential issue here regarding human rights in that implies that the kangaroo court is required to comply withe the likes of the United Nations Declaration on the Rights of Persons with Disabilities.
