Get Children out of Detention

Detention is no place for a Child

“Children in detention exhibited symptoms including bed wetting, sleep walking and night terrors. At the severe end of the spectrum, some children became mute, refused to eat and drink, made suicide attempts and began to self-harm, such as by cutting themselves. Some children also were not meeting their developmental milestones”

– A Last Resort?: National Inquiry into Children in Immigration Detention (HREOC) 2004

Six years later 723 children are in detention.

Now is the time to change this.

The Greens are introducing legislation to exempt children under the age of 18 years from detention.
This would see these children and their families released into the community while they go through the refugee assessment process in the same way that thousands of asylum seekers who arrive by plane are treated.

This is the first step towards ending mandatory detention.

Exempting Children from Detention is the first step to the law requiring that EVERY man, woman and child entering Australia by boat is locked up.

The over-riding nature of this law means that even though the government says that Children will be detained as a last resort along with people who have been tortured, that this cannot happen.

The law is the law and what this means is that EVERYONE is locked up as a first resort no matter how damaging and injurious this detention may be.

ENOUGH IS ENOUGH- Now is the time to act.

Under the Migration Act ( section 10) a child born in Australia
to unlawful non-citizens,
is taken to have entered Australia at birth.
The child is taken to be an unlawful non-citizen from birth.
As an unlawful non-citizen that baby must be locked up at birth.
This is mandatory detention.
